SUMMARY of Fisher Hill Homeowners’ Deed, Covenants, & Guidelines (1 March 2006)

The following will serve as a summary of key Fisher Hill Home site covenants, guidelines and restrictions for all prospective lot purchasers and will be incorporated into each homeowner’s deed.  All 6 lot owners within the community will have an automatic membership interest in the Common Property, comprising approximately 75 acres.

The Homeowners’ covenants, restrictions, and architectural guidelines have been carefully crafted to both enhance property values and to sustain the environmental integrity of the Adirondack Park.

All lots shall be used for residential purposes only.

The annual  fee for Common Property maintenance and taxes currently (2005) is approximately $717 (+/-$100) for each member.  Shared drive - road maintenance will be apportioned among the members.  Such costs will be incorporated into the monthly fees as appropriate.

The Common Property is to be used only for purposes of hiking, walking, cross-country skiing, snow shoeing, biking, birding, observation and related passive (non-motorized) recreational activities.

All homes and substantial improvements shall be subject to architectural guidelines and review.

All homes, garages and accessory structures shall be of a design compatible with Adirondack style architecture.  Exterior color schemes shall be earth tone or muted (preferably dark). All major roofs will be symmetrical gable forms with a minimum pitch of 8:12.  Residential footprints shall not exceed a maximum of 2700 square feet (but shall be at least 1200 sq. ft.) with a heated interior area of between 1200 and 4000 square feet.  If the lot 4 purchaser opts to use the old mansion foundation, a 3600 square foot foundation shall be permitted.  A 24 foot height restriction exists on this foundation site.

Windows shall not occupy more than 1/3 of the exterior-heated wall area.  Skylights and/or extensive, uninterrupted glass fenestration shall not be permitted.

Accessory structures such as a barn, lean-to, wood shed, or storage shed shall be allowed provided each structure is less than 16 feet in height and less than 600 square feet in area, except for lots 5 and 8.  Accessory structures should be designed to match the home in that materials, colors, roofing, roof pitch much be consistent with the residence on the site.

Garages shall not dominate residential facades; all residential units shall have side entry garages or recessed garages where the front of the garage is at least five feet behind the front line of the living portion of the principal dwelling.  If a garage is front-facing, garage doors shall be scaled for a single vehicle.

All construction and private access drives shall be at least 55 feet from the maple trees lining the main entrance driveway and at least 50 feet from any lot boundary, except for Lot 6 where 25 feet is allowable

Once residential construction is started, it must be completed within 14 months.  During construction of a new house or ancillary facility, all on site “Port a Potties” and dumpsters must be screened from public view.  Screening may be made of black construction site netting suspended between poles, or wood lattice work

Clotheslines, unlicensed vehicles, RV’s, motorcycles, boats, snowmobiles, etc. must be screened from view .

No livestock shall be permitted, except on lots 1 and lot 5, where two horses shall be permitted on each lot.

Except for lots 2 and 3, where one two-lot subdivision is permitted, lots shall not be subdivided.

Chain link fencing shall not be permitted in the front yard or along property lines.

The complete Fisher Hill HOA Declaration and related documents included in the New York State Attorney General CPS-7 application will be made available to the buyer upon reaching general agreement to purchase but prior to the signing of the Contract of Sale. The CPS-7 application includes, among other things, the Adirondack Park Agency Project permit, the Master Site Maps 5911 & 5912, the Declaration, the Owners’ Title Insurance Policy and the HOA Budget.
